Luminera: SEO, GEO and AI search optimisation services

This page has two parts. Part A is our Terms of Service, and Part B is our Privacy Policy. Together they apply to all services provided by Luminera ("we", "us", "our") to you, the client ("you"), including our free services. By booking a service, requesting a Free AI Visibility Check, or submitting any request form on our website, you agree to both parts.

PART A, TERMS OF SERVICE

‍ ‍

1. Who we are

‍ ‍

Luminera is a digital marketing business based in Northland, New Zealand, specialising in search engine optimisation (SEO), generative engine optimisation (GEO) and AI search optimisation (AIO). You can contact us at info@luminera.co.nz or +64 22 060 4967.

2. Our services

‍ ‍

We offer three services:

‍ ‍

Free AI Visibility Check. A no charge report showing what selected AI search engines say about your business in response to three questions you provide. There is no fee, no obligation to purchase anything, and no sales call unless you ask for one. Because each report involves manual work, we may limit how many we accept at a time, may operate a waitlist, and may decline a request at our discretion.

Audit & Foundations Build. A one off, hands on technical and structural setup of your website and online profiles, for a fixed fee of $4,000 NZD.

‍ ‍

Ongoing Visibility Partnership. An ongoing monthly service at $1,800 NZD per month, which you may cancel at any time. New Partnership clients also receive Meet the Locals, a curated welcome gift of goods from other Northland small businesses valued at around $500 NZD. This is a gift, not a fee discount, and its contents, availability and value may vary.

The specific work included in each service is described on our website and in any plan or proposal we provide to you. We may use third party tools and platforms, including project management and AI tools, to carry out our work, and we will be transparent with you about how these are used. See our Privacy Policy in Part B for more detail. Our services may vary from business to business, as the work depends on what makes the most sense for your business and branding.

3. What we do and do not guarantee

‍ ‍

We guarantee that we will carry out our services with reasonable care, skill and diligence, and with honesty and transparency about what we are doing and why.

‍ ‍

We do NOT and cannot guarantee any specific outcome, including but not limited to: particular search engine rankings; inclusion or recommendation by AI systems such as ChatGPT, Google AI Overviews, Gemini, Perplexity or Claude; specific volumes of traffic, leads, enquiries or sales; or the timeframe in which any results may appear. These outcomes depend on third party algorithms and platforms that we do not own or control, and which change without notice. Any timeframes we mention, such as results typically appearing within 3 to 6 months, are good faith estimates, not promises.

We do make two commitments about our own work. These are promises about what we will do, not promises about what will result.

‍ ‍

The Build completion guarantee. Your Audit and Foundations Build will be live within 40 days of us receiving everything we have asked from you. If we miss that deadline, your first month of the Ongoing Visibility Partnership is provided at no charge. The 40 day period begins only once you have supplied all requested information, materials and access, and pauses at any point we are waiting on you.

The keep-working guarantee. If your business is not cited in AI answers for at least one of your agreed core queries by month six of a continuous Ongoing Visibility Partnership, we will keep carrying out the Partnership work at no charge until it is, for up to three additional months. This is a commitment to keep working, not a promise that the result will occur, and it does not alter the position above that we cannot guarantee inclusion or recommendation by any AI system. It applies where the Partnership has run continuously, all invoices are current, and you have provided the access, approvals and information we have requested within a reasonable time.

What a core query means. A core query is a question a customer in your area would realistically ask when they are ready to purchase, naming what you do and where you do it. Searches for your own business name are excluded, as are general research questions with no purchase intent. We agree five core queries with you in writing before work begins, and they are recorded in your monthly reporting.

‍ ‍

The Free AI Visibility Check carries no guarantee of any kind. It reports what we observed at the time we ran it. AI systems generate a new answer each time they are asked, so results vary between runs and may differ from what you see yourself. The report is a snapshot, not a prediction, and is provided for your information only. Any action you take on the basis of it is your own decision.

4. Your responsibilities

‍ ‍

For our paid services, we rely on you to:

‍ ‍

  • Provide accurate information about your business, and the access we need to platforms such as your website, Google Business Profile, and analytics accounts.

  • Respond to requests for information, approvals or feedback within a reasonable time.

  • Ensure that any content, images or materials you provide to us are accurate and that you have the right to use them.

‍ ‍

Delays or inaccuracies in the information or access you provide may affect our ability to deliver the service, may pause any guarantee period, and may affect estimated timeframes.

‍ ‍

For the Free AI Visibility Check we need only your name, contact email, business name, general location, and the three questions you would like us to run. No account access is required, and we will not ask for any.

‍ ‍

5. Approvals and changes to your website

‍ ‍

Where our work involves changes to your website, such as adding code, restructuring content, or publishing new material, we will seek your permission before those changes go live, unless we have agreed otherwise in writing. The Free AI Visibility Check involves no changes to your website or accounts of any kind.

‍ ‍

6. Fees and payment

‍ ‍

Our current fees are $4,000 NZD for the Audit & Foundations Build, charged once, and $1,800 NZD per month for the Ongoing Visibility Partnership, billed monthly. All fees are in New Zealand dollars and include GST. The Free AI Visibility Check is provided at no charge and creates no payment obligation.

‍ ‍

Invoices are payable by the due date stated on the invoice. We may pause or suspend services where invoices remain unpaid.

‍ ‍

7. Cancellation

‍ ‍

You may cancel the Ongoing Visibility Partnership at any time. Cancellation takes effect at the end of the monthly period you have paid for, and we do not charge cancellation fees. Fees already paid for a completed period are not refundable except where required by law. The Audit & Foundations Build is a one off engagement, treated as complete on delivery of the build. The Free AI Visibility Check may be withdrawn by you at any time before we send your report, simply by emailing us.

8. Ownership

‍ ‍

Once you have paid for a service, any deliverables we create specifically for you are yours to use. Your Free AI Visibility Check report is also yours to keep and use however you wish, including having another provider act on it. Where relevant, you own your website, domain, accounts and data, and we simply work on them with your permission. We retain ownership of our own underlying methods, software, templates, know how and any pre-existing materials, including the AI visibility tracking software we have built and use to produce reports.

9. Confidentiality

‍ ‍

We will treat information about your business that is not publicly available as confidential, and use it only to provide our services to you. We may refer to you as a client and describe our work in general terms, for example in a portfolio or case study, unless you ask us in writing not to. We will not publish the contents of your Free AI Visibility Check report, or name your business in connection with it, without your written permission.

10. Privacy

‍ ‍

We handle personal information in accordance with the New Zealand Privacy Act 2020 and our Privacy Policy in Part B below, which forms part of these terms.

‍ ‍

11. Liability

‍ ‍

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or other New Zealand law that cannot lawfully be excluded.

‍ ‍

Where you acquire our services for the purposes of a business, and to the extent permitted by law, the parties agree that the Consumer Guarantees Act does not apply, as this contracting out is fair and reasonable in a business to business context.

‍ ‍

To the maximum extent permitted by law, we are not liable for indirect or consequential loss, or for loss of profits, revenue, traffic or business, arising from our services. Where we are found liable, our total liability is limited to the amount of fees you have paid us for the service giving rise to the claim. As no fee is paid for the Free AI Visibility Check, and to the maximum extent permitted by law, we accept no liability arising from it.

12. If something goes wrong

‍ ‍

We genuinely want you to be happy with our work. If you are unhappy, or feel there is a gap between what was promised and what was delivered, please contact us first so we can discuss it, put it right where we can, or clear up any misunderstanding. Open communication helps us learn and improve. This does not affect your rights under New Zealand consumer law.

13. Changes to these terms

‍ ‍

We may update these terms from time to time. The version published on our website at the time you book or renew a service, or request a Free AI Visibility Check, is the version that applies to you. Material changes affecting an ongoing engagement will be communicated to you.

14. Governing law

‍ ‍

These terms are governed by New Zealand law, and the New Zealand courts and Disputes Tribunal have jurisdiction over any dispute.

PART B, PRIVACY POLICY

‍ ‍

1. Scope

‍ ‍

This policy explains how Luminera collects, uses, stores and discloses personal information, in line with the New Zealand Privacy Act 2020. It applies to information we collect from clients, prospective clients, people who request a Free AI Visibility Check, and visitors to luminera.co.nz.

2. What we collect

‍ ‍

  • Contact and business details you give us. Name, email, phone, business name, and information about your business submitted through our request forms or in conversation.

  • Free AI Visibility Check submissions. Your name, email, business name, general location or region, your website address if you have one, and the three questions you ask us to run. We also retain the report we produce for you.

  • Access credentials or permissions you grant us to third party platforms such as your website, Google Business Profile, Google Analytics and Google Search Console, solely to carry out a paid service you have engaged us for. We do not request or require any access for the Free AI Visibility Check.

  • Content and materials you provide, such as photos, copy, or business information used to build your foundations or ongoing content.

  • Photography we take on site for Northland based Ongoing Visibility Partnership clients, for use on your Google Business Profile and website.

  • Standard website usage data collected by our website platform, Squarespace, and any analytics tools we run on luminera.co.nz, such as pages visited and general location or device data.

  • Invoicing and payment details necessary to bill you for paid services.

3. How we use it

‍ ‍

  • To produce and send you your Free AI Visibility Check report.

  • To deliver any paid service you have booked, including audits, technical builds, Google Business Profile and website management, and monthly reporting.

  • To respond to enquiries and communicate with you about your request, account or engagement.

  • To refer to you as a client or describe our work in general terms, for example in a portfolio or case study, unless you ask us in writing not to. See clause 9 of Part A.

  • To invoice and collect payment for paid services.

  • To meet our legal and accounting obligations.

Marketing. We will not add you to any mailing list or send you marketing communications unless you have specifically opted in, by ticking the relevant box on one of our forms. If you request a Free AI Visibility Check and do not opt in, we will contact you about that report and nothing else. You can opt out at any time by emailing us or using the unsubscribe link.

‍ ‍

We do not sell your personal information, and we do not use it for purposes unrelated to providing our services without asking you first.

‍ ‍

4. Third parties and AI tools we use

‍ ‍

We use a small number of third party tools to help deliver our services, and we are upfront about them.

‍ ‍

  • Google products including Analytics, Search Console and Business Profile, operated under your own accounts, which you grant us permission to access for paid services.

  • ClickUp, a project management tool, which we use to organise work, manage our daily tasks and compile reporting.

  • AI search engines, used to produce your visibility reports. To run a Free AI Visibility Check, or the ongoing tracking included in an Ongoing Visibility Partnership, we submit the questions you provide, along with your business name and general location, to third party AI services. These currently include OpenAI (ChatGPT), Perplexity, Google (AI Overviews and Gemini) and Anthropic (Claude), and the list may change as the market does. These queries are made in the same way any member of the public could make them. We do not submit your contact details, your account access, or any confidential information about your business to these services.

  • Claude (Anthropic) and similar AI tools, used to help structure ideas, spell check, assist with technical fixes, and compile information we have already gathered ourselves. AI is never used to fabricate reviews, invent expertise, or publish content under your name without your review. Anything published under your name is grounded in real information and approved by you first.

These providers only receive the information needed to perform their function for us, and are not permitted to use your information for their own purposes. We do not otherwise share your personal information with third parties, except where required by law.

‍ ‍

5. Data storage and security

‍ ‍

We take reasonable steps to keep your information secure and to limit access to our team. No online system is completely secure, but we do not store more personal information than we need, and we review access to client accounts and platforms periodically.

‍ ‍

6. How long we keep it

‍ ‍

We keep personal information for as long as we are actively providing services to you, and afterwards for as long as is reasonably necessary to meet legal, accounting or dispute resolution obligations.

‍ ‍

Where you have requested a Free AI Visibility Check and do not go on to engage us, we keep your submission and your report for 12 months, so that we can compare results if you come back to us later, and then delete them. You can ask us to delete them sooner at any time.

‍ ‍

7. Cookies and website analytics

‍ ‍

Our website is built on Squarespace, which sets its own functional cookies to operate the site, and we may use analytics tools to understand general visitor behaviour, such as which pages are viewed. This data is aggregated and not used to personally identify you unless you have also submitted a form to us.

‍ ‍

8. Your rights

‍ ‍

Under the Privacy Act 2020, you have the right to ask what personal information we hold about you, request a correction if it is wrong, and ask us to delete it where we are not required to keep it. To make a request, email info@luminera.co.nz. If you are unhappy with how we have handled your information, you can also complain to the Office of the Privacy Commissioner at privacy.org.nz.

9. Children

‍ ‍

Our services are directed at businesses, not children. We do not knowingly collect personal information from minors.

10. Changes to this policy

‍ ‍

We may update this policy from time to time. The version published on our website at the relevant date applies.
